1. Introduction

Welcome to Herdex. Herdex is an online marketplace that allows users to create, browse, and respond to listings for alpacas and other smallholding animals.

By accessing or using the website, you agree to these Terms & Conditions. If you do not agree, please do not use the platform.

2. About Herdex

Herdex provides a platform for buyers, sellers, stud owners, and enquirers to connect. Herdex does not buy, sell, own, transport, inspect, or handle animals listed on the platform and is not a party to any transaction or arrangement between users.

Any agreement, payment, collection, transport, breeding arrangement, or other arrangement is made directly between users.

3. Accounts and listings

Users are responsible for ensuring that the information they provide to Herdex is accurate, complete, and not misleading.

If you create a listing, you are responsible for the content of that listing, including descriptions, images, prices, location details, and any claims made about the animal or animals listed.

Herdex may review listings before publication or remove listings that appear misleading, inappropriate, unlawful, or otherwise unsuitable for the platform. However, any such review is limited to platform moderation and does not amount to verification, certification, or endorsement of a listing, user, or animal.

4. No verification or guarantee

Herdex does not verify the identity of every user, the accuracy of every listing, or the health, condition, ownership, suitability, legality, or quality of any animal listed on the platform.

Buyers, sellers, stud owners, and enquirers must carry out their own due diligence before proceeding with any transaction or arrangement. This may include checking identity, ownership, paperwork, health status, transport arrangements, breeding suitability, and compliance with any applicable laws or regulations.

5. User responsibilities

By using Herdex, you agree to:

• Provide accurate and truthful information
• Use the platform lawfully and in good faith
• Not post misleading, fraudulent, offensive, or unlawful content
• Comply with all relevant animal welfare, movement, identification, breeding, and transport rules
• Carry out your own checks before buying, selling, reserving, arranging breeding services, or transporting any animal

6. Transactions and arrangements between users

All transactions and arrangements take place directly between users. Herdex is not involved in payments, delivery, collection, transport, veterinary checks, breeding services, or disputes between users.

Users should take appropriate precautions and make their own assessments before entering into any agreement or arrangement. Where appropriate, this may include viewing animals in person and requesting supporting documentation from the seller, owner, or advertiser.

7. Prohibited use

You must not use Herdex to:

• Post false, misleading, or deceptive listings
• Impersonate another person or misrepresent ownership or authority
• Upload unlawful, abusive, or infringing content
• Use the platform to harass, scam, or exploit other users
• Interfere with the operation or security of the website

8. Removal and suspension

Herdex reserves the right to remove listings, suspend accounts, or restrict access to the platform where we reasonably believe a user has breached these terms, acted unlawfully, or used the platform in a way that may harm other users or the integrity of the marketplace.

9. Limitation of liability

To the fullest extent permitted by law, Herdex shall not be liable for any indirect, incidental, consequential, or business loss arising out of or in connection with use of the platform or any transaction, arrangement, or attempted transaction between users.

Nothing in these Terms & Conditions excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

10. Changes to these terms

We may update these Terms & Conditions from time to time. The latest version will always be posted on this page. Continued use of the platform after any update indicates acceptance of the revised terms.
